Botify Terms of Service

1. Acceptance of Terms

By accessing or using Botify ("the Platform"), creating an account, or connecting your Instagram Business account, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you disagree with any part of these terms, you may not use our service.

2. Service Description

Botify is a Software-as-a-Service (SaaS) platform that enables content creators, influencers, and businesses to:

• Create AI-powered chatbots for Telegram and Instagram
• Automate direct message responses
• Monetize fan interactions through automated sales flows
• Analyze engagement and revenue metrics
• Manage multiple social media bots from a centralized dashboard

3. Account Registration and Security

3.1 Account Requirements

• You must be at least 18 years old to use Botify
• You must provide accurate and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorized account access

3.2 Instagram Business Account Requirements

• Instagram accounts connected to Botify must be Business or Creator accounts
• You must have legitimate authorization to manage the connected Instagram account
• Connected accounts must comply with Instagram's Terms of Service
• You are responsible for maintaining your Instagram account in good standing

4. Instagram Integration and Data Usage

4.1 Authorization and Access

When you connect your Instagram account to Botify:

• You grant Botify permission to access your Instagram profile and messaging data
• We store encrypted access tokens to maintain the connection
• We access only the data necessary for bot functionality
• You can revoke access at any time through your Botify account settings

4.2 Automated Message Processing

• AI Response Generation: Your Instagram DMs are processed by AI services to generate automated responses
• Message Storage: Conversations are stored for analytics, bot training, and service improvement
• Compliance Monitoring: Messages are monitored to ensure compliance with platform policies
• No Human Review: Messages are processed automatically unless you request human intervention

4.3 Compliance with Instagram Policies

• All bot activities must comply with Instagram's Terms of Service and Community Guidelines
• Automated responses respect Instagram's 24-hour messaging window
• Bot behavior must not violate Instagram's spam or automation policies
• You are responsible for ensuring your bot content is appropriate and compliant

5. Subscription and Payments

5.1 Subscription Plans

• Free Plan (Spark): Limited bot and message quotas
• Paid Plans: Enhanced features, higher quotas, premium AI models
• Voice Add-ons: Premium voice message capabilities
• Enterprise: Custom solutions for high-volume users

5.2 Payment Terms

• Subscription fees are billed monthly in advance
• All fees are non-refundable except as required by law
• We reserve the right to change pricing with 30 days' notice
• Accounts may be suspended for non-payment

6. User Obligations and Acceptable Use

6.1 Content Responsibility

• You are solely responsible for bot personalities, responses, and automated content
• Content must not be illegal, harmful, threatening, or violate others' rights
• Bot responses must not impersonate others or misrepresent identity
• You must disclose that responses are AI-generated when required

6.2 Prohibited Uses

• Spam, harassment, or unsolicited commercial communications
• Collection of user data without consent
• Violating Instagram's or any platform's terms of service
• Creating bots that spread misinformation or harmful content
• Attempting to circumvent platform limitations or security measures

7. Intellectual Property Rights

7.1 Botify Platform

• Botify retains all rights to the platform, software, and related intellectual property
• You receive a limited, non-exclusive license to use the platform per these Terms
• You may not copy, modify, or distribute our software or content

7.2 User Content

• You retain ownership of bot personalities and custom content you create
• You grant Botify a license to use your content for service operation
• AI-generated responses are considered derivative works of your bot configuration

8. Service Availability and Support

8.1 Service Level

• We strive for 99.9% uptime but cannot guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• Instagram API dependencies may affect service availability

8.2 Support and Assistance

• Documentation: Comprehensive help guides and tutorials
• Email Support: Available for all paid plan users
• Priority Support: Faster response times for premium plans

9. Limitation of Liability

To the fullest extent permitted by law:

• Botify is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the last 12 months
• You use the service at your own risk and are responsible for compliance with all applicable laws

10. Termination

10.1 Termination by User

• You may cancel your account at any time
• Cancellation takes effect at the end of the current billing period
• You can export your data before termination

10.2 Termination by Botify

• We may suspend or terminate accounts for Terms violations
• We may terminate service with 30 days' notice
• Immediate termination for serious violations or legal requirements

11. Instagram-Specific Terms

11.1 Platform Compliance

• You agree to comply with Instagram's Terms of Service and Community Guidelines
• You understand that Instagram may change policies affecting bot functionality
• We may disable Instagram features to maintain platform compliance

11.2 Connection Dependencies

• Instagram bot functionality depends on Meta's API availability
• Service interruptions may occur due to Instagram policy or technical changes
• We are not responsible for Instagram-related service disruptions

12. Indemnification

You agree to indemnify and hold harmless Botify from any claims, damages, or expenses arising from:

• Your use of the platform or violation of these Terms
• Content created by your bots or automation rules
• Violations of third-party rights or applicable laws
• Your Instagram account activities or policy violations

13. Governing Law and Disputes

• Governing Law: These Terms are governed by Florida state law and federal laws of the United States
• Dispute Resolution: Disputes will be resolved through binding arbitration in Miami, Florida
• Class Action Waiver: You waive rights to participate in class action lawsuits
• Jurisdiction: Miami-Dade County, Florida for any legal matters not subject to arbitration

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Botify.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.

14.3 Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated with 30 days' notice.
